A Meeting of the above Parish Council was held on the16th May 2005, in Coronation Hall, in accordance with the Local Govt Act 1972, due notice having been given
The meeting opened at 7.15pm
Present:-Cllrs G Smailes (Chairman), G Owens (Vice Chair), M Rae, G Parr, R Wilkinson, L Proctor, M Lister, Y Jacobs (clerk), 1 visitor.
Cllr Merson arrived at 7.30pm
1) Apologies:- Cllr J Graham, P.C. N. Waite
Cllr Rae agreed to act as Chairman for Cllr Smailes as he had “drawn up” the agenda with Mrs Jacobs.
Cllr Wilkinson had an interest in items 6a, 6b. Cllr Lister had an interest in item 7d.
There was no receipt of gifts above £25.00
2) Minutes:-The minutes of the meetings held on 7th March, 31st March and
18th April 2005, having been copied & distributed were amended, confirmed and signed. Resolved.

Mrs Jacobs advised that a new bank mandate will be required owing to a change of Chairman and Vice Chairman

In view of the visitor attending the meeting, item 6l) was discussed.
Cllr Rae advised of the action/responses taken, since the 7th March Parish Council meeting, relating to the ongoing dispute about the pathway over the village green.
He then read a recent letter from Harts Solicitors, which confirms Mr Ellis’ intention to completely remove the path, but that the timescale originally given for this completion, by the P.C. was considered unreasonable.
Action: - Mrs Jacobs to write to Harts, thanking for the agreement to the removal of the path, but asking when this will be completed. Review-18th July meeting.
4) Correspondence
a) Boroughbridge Town Council – Annual Mayor Making
No one was available to attend

b) Trafalgar Weekend
Cllr Rae explained the above event & proposed this be brought up at the JPC.
Action: - Cllr Rae to deal.
c) March of the Volunteers-Ripon Cncl for Volun. Service
Cllr Rae informed the committee about this event on the 4th June 2005.

d) Mazars Audit
Cllr Rae confirmed that the year end accounts had been completed by Mrs Jacobs and the Internal Audit would take place in the near future. Cllr Merson agreed to participate again this year in the joint audit session should he be available, otherwise Cllr Rae would take his place.
The Statement of Assurance was duly completed by the Councillors and the audit document signed.
Cllr Merson proposed that the accounts be publicised on the Kirby Hill website.
Action: - Mrs Jacobs to “post” notice for inspection of accounts and email accounts to Cllr Owens for website. Contact Cllr Collins for audit dates.
e) Harrogate Boro Council-LDF- Draft Supplementary Planning Document- House Extensions/Garages – Design Guide
This document was passed to Cllr Owens for use with the VDS.

f) Harrogate Borough Cncl- Knaresborough Housing Office
Cllr Rae confirmed that the Knaresborough office had now closed, due to restructuring of the Dept of Health and Housing
Action:-Mrs Jacobs had already posted notices.
g) NYCC. Winter Service 2005/6
The councillors were asked to advise Mrs Jacobs by 15th July should there be any routes in the parish that could be improved upon with the winter gritting service.

h) Harrogate Boro. Cncl – Changes to Structure
The ex NYC Cllr C Wilson had, at a previous meeting advised of these changes within Harrogate Boro. Council.

i) Harrogate Borough Council/Hambleton Dist. Cncls – Notice of Election
Cllr Rae confirmed that all election notices had been received and “posted” within the parish by Mrs Jacobs

j) Footpath outside old Kirby Hill Primary School
This footpath was causing concern for adults with pushchairs and children walking to school; it was extremely uneven and narrow in one area, thus causing pedestrians to walk on the road. Cllr Rae advised that Mrs Jacobs had spoken to the site foreman and whilst the path had been temporarily smoothed out, it was still causing a problem with the use of heavy plant vehicles crossing the pavement onto the building site.

k) Hambleton Dist Cncl- LDF
Information leaflets were handed out to councillors.

l) NY. Fire & Rescue Service
A thank you letter had been received about the completion of a questionnaire.

m) Resident’s letter re Village Green Concerns
Cllr Rae read a letter from a local resident complaining about children entering her garden without permission to retrieve their football, when playing on the village green. Unfortunately some shrubs and her garden fence had been damaged.
Cllr Rae had acknowledged the letter advising that it was hoped that when the Langthorpe Play Area was completed this would relieve the aggravation.
Cllr Wilkinson had full sympathy with this resident’s worries and the visitor had concerns about the children’s safety when climbing the trees and asked about insurance; the P.C. is covered for such injuries.
Action:-Mrs Jacobs to write to resident advising that councillors are urgently trying to find in the village an area for a kick about.
6g) Commuted Sums/ 106 Money/Langthorpe Play Area
This item was brought forward in view of the concerns about the residents and children’s issues relating to the village green.
Primarily, Cllr Parr asked for confirmation of this P.Cs intention to the commitment of money to Langthorpe P.C. Cllr Rae confirmed that as it was thought that no play area site existed within the parish, then the full allocation of CEPA money had been assigned to Langthorpe. Secondly, he advised that there is no time limit on the spending of the CEPA money held by this P.C.
Cllr Parr reiterated his past thoughts on the P.C. attempting to find a plot of land within the parish for a kick about area and suggested a site behind The Croft, near the Pumping Station.
Cllr Merson proposed that potential sites be looked at; it was agreed that Cllr Parr and Cllr Wilkinson would look into this quickly.
Thirdly, Cllr Parr confirmed that Hg. Boro. Cncl are still waiting verification from their legal dept, that the money allocated for the CEPA could be utilised for Langthorpe Play Area.
It was agreed that Cllr Parr would be the council’s representative on the Langthorpe Play Area Committee should further meetings arise.

5) Clerks/Councillors Reports & Meetings
a) Joint Parish Council Meeting – Speeding/grass cutting Leeming lane, Minutes & Agendas
Cllr Owens advised that when the play area and the farm shop are open, pressure will be applied to NYCC for a reduction in the speed limit on Leeming Lane. He also confirmed that Langthorpe P.C is now aware that this P.C will continue with the existing grass cutting service provided by Harrogate Boro. Council.
Mrs Jacobs mentioned that she had not received any agenda/minutes for the JPC, but had been asked by Roecliffe P.C. to forward these to two different sources within that committee – not the clerk.

b) Harrogate Borough Council – Planning for your Community & Harrogate Dist up to 2021
Cllrs Owens and Smailes had attended this workshop. Cllr Owens explained how the LDF would replace the Local District Plan and would cover the next 20 years. The main development for this area is in Boroughbridge, but there is little scope available in Kirby Hill. Further consultation will be taking place over the next few years and this could prove influential to our locality.
Cllr Rae had previously written to the Boroughbridge Partnership Investment/ Renaissance Market Town Initiative working party advising that Boroughbridge should not encroach the boundary of Kirby Hill. It was agreed that Cllr Rae should send a copy of this letter to Harrogate Borough Council, Dept of Tech. Services.

c) Police Liaison
Cllr Wilkinson gave a report on the last meeting, advising that the new Chief Inspector is R. Spedding.

d) Emergency Plan Committee
Cllr Rae reported that the plan would be lodged with NYCC by the end of November 2005 and then gave an overall insight to the working/setup of the document. This is specifically designed for flooding, but could accommodate other emergencies. There is to be a ‘dummy run’ in the foreseeable future.

e) Boroughbridge Partnership Investment/Renaissance Market Town Initiative
Cllr Rae will be attending the next meeting, which is to discuss how the plan will be written, produced and funded for the projects.

f) Annual Parish Meeting – Dog Warden/Safer Comm. Service
It was agreed to advertise in Beyond the Pews the Dog Chipping Service, which is provided by Harrogate Borough Council. Should there be sufficient interest, then a date would be arranged with Harrogate to proceed.

It was decided to carry to the next agenda the item relating to Safer Communities. Mrs Jacobs advised that Mr Collins had already arranged a notice to be entered into Beyond the Pews for Langthorpe, with a small note that Kirby Hill Parish Council would also be dealing with this in the future.

g) Coronation Hall Agm
Mrs Jacobs gave a report on the AGM and the last meeting, advising that the newly elected hall President, in place of the late Tommy Schofield, was Ian Hick.
The lettings for hall remain high and rent of rooms are unchanged.
Applejacks Play Group was congratulated on an excellent Ofstead Report.
Mr Richard Pickles (Landlord at The Grantham Arms) gave a detailed report into the new Licensing Act.

c) Road/Pavement Conditions in Kirby Hill
The road/pavement renewal works are to commence over the next few months.

d) Speeding- Milby to Brafferton Bridge/resiting of Church Lane 30mph Sign
Before retiring NYC Cllr C. Wilson had urged these works. NYCC advise that it is hoped they will be completed in this financial year, providing no objections being raised following consultation & advertising of the Traffic Regulation Order.

Cllr Wilkinson confirmed that the benches will be completed by the next meeting.

f) VDS
Cllr Owens thanked those who participated in the discussions for the VDS; those interviews were now to be analysed by the students and a report would be shortly issued. He advised of a meeting to be held on 21st June in Coronation Hall, 8.00pm to 9.30pm to share the public views, taken from those actual interviews.
Cllr Owens hopes that the VDS will be included in the Harrogate Boro. Council LDF and therefore be influential in future planning.
He also asked if the P.C would be willing to pay for the rent of Coronation Hall for the 21st June meeting; this was agreed by all councillors.

g) Commuted Sums/106 Monies- Langthorpe Play Area Representation

h) Boundary Hedge at old Kirby Hill School
The hedge, belonging to the converted property (old Kirby Hill School), is badly encroaching the village green. Mr Foster when cutting the grass on the green is having problems with that area.
Action:-Mrs Jacobs to write to owner and request that this be tidied/ maintained
i) Litter problems – Dishforth Road
Mrs Jacobs confirmed that Harrogate Bor. Council had tidied up this area.

j) Residents Enquiry – Regarding Pollarding of Lime Trees & Removal of Hawthorne Hedge
Cllr Rae explained how a local resident had been upset at the harsh cutting back of the Hawthorne hedge in lower Church Lane and the pollarding of the Lime trees on the village green.
Harrogate Boro. Council had dealt with both enquiries and maintained that the Hawthorne hedge was now growing again; a further check would be kept on this during the summer.
The pollarding was carried out by a reputable company, who maintained that this type of pruning to the trees was historical. Pollarding had in fact been carried out on several previous occasions and as such this was the only way now to deal with those trees.
This had been fully explained to the resident and accepted.
