Kirby Hill and District Parish Council

Inc. Thornton Bridge, Humberton, Ellenthorpe and Milby

A meeting of the above Parish Council was held on the 14th March 2006 in the Bradley Suite of Coronation Hall, Milby, in accordance with The Local Govt. Act 1972, due notice having been given. The meeting opened at 7.15pm.

Present: - Cllrs Smailes (Chairman), Owens (Vice Chair), Lister, Parr, Merson, Wilkinson, Graham, Proctor. NYCCllr N Wilson arrived at 8.10pm. 1 visitor.

1.     Apologies:- Mr Rae

2.     Code of Conduct: - Cllr Wilkinson had interests in items 8a, 8b, and 9c. Cllr Owens in 9d. No gifts of £25.00

3.      Minutes:-The minutes of the meeting held 9th January 2006 had been copied & distributed prior to this meeting. Proposed Cllr Graham seconded Cllr Proctor. Resolved

4.      Co-option of councillor for Milby: - Upon the resignation of Cllr Rae there is now a vacancy in Milby. There had been no names forthcoming, so Mrs Jacobs will post a notice on the Milby board and had arranged an entry in Beyond the Pews for the April issue.

It was proposed by Cllr Graham to give the Chairman an allowance of £100.00 for future expenses, seconded by Cllr. Wilkinson

b.      Harrogate Boro. Cncl – LDF Supp. Planning Doc. Provision for Open Space, Sport & Recreation/Provision for Village Halls Consultation on Preferred Options & Sustainability Appraisal.
This is linked to the play area/106 money which was to be discussed later. Papers with clerk

 

c.       Harrogate Boro. Cncl – Spring Clean
Cllr Merson volunteered his family for the above; Mr Rae had also shown an interest in continuing with this activity.
Cllr Owens asked that it be confirmed with Hg. Boro. Cncl if/when wheelie waste bins will be provided to improve the collection of household rubbish.

d.      Harrogate Boro. Cncl – Dog Waste Bins
Is a dog waste bin required in Kirby Hill?
Action:-Mrs Jacobs to advise and confirm position of intended bin.

e.      Resignation of Councillors/Clerk
Cllr Smailes confirmed that Cllr Rae had resigned from the Council as he was to take up the position of clerk with effect form 1st May 2006.

He then read a letter which he had received from Mrs Jacobs advising of her resignation as from the 28th April 2006. (A presentation was made to her after the council meeting; she thanked the councillors for their gift and help over the 7 years, stating how she had thoroughly enjoyed her time with the Parish Council)

It was then confirmed that Cllr Proctor was also resigning from the Parish Council that evening. (A presentation and celebration of his 27 years, including some as past chairman, took place after the meeting)

Cllr Graham confirmed that she would be resigning from her position as councillor for the parish of Thornton Bridge at the end of this meeting, stating that she would like to be considered for co-option of the vacancy left by Cllr Proctor. Mrs Jacobs confirmed the procedures to be carried out.

f.       Hightimers Banners
Cllr Smailes read a letter from a representative of Hightimers querying the legality of positioning banners, which advertise their forthcoming events; this was a result of a statement from the ODPM. Mrs Jacobs had contacted NYCC, who then moved a banner from the roundabout railings to those over the Milby canal.

The councillors felt that this should be clarified by the Hightimers on each occasion with Local Planning Authority (LPA).

Cllr Lister also mentioned that a hording had also been erected on the Milby to  Helperby Road, positioned on a bad corner. It was also mentioned that the same company had placed a board on the B6265 Ripon Road.

7.     CLERKS/COUNCILLORS REPORTS & MEETINGS

a.       Police Liaison
Cllr. Parr gave a detailed report on the meeting advising that there had been a very good attendance due to the proposed future reorganisation of the force, which locally involved north and south Boroughbridge. It was agreed to retain the tier meetings and additional policing will be available. Cllr Smailes thanked Cllr Parr.
Action:-none

b.      JPC
The next meeting will be 16th March; Cllr Owens requested a new councillor join the JPC as Mr Rae had resigned. Cllr Graham confirmed that she will would join the JPC at their next meeting in June, when she is re instated onto the P. C.
Cllr Owens will raise the ongoing issue about speeding and parking problems on Leeming lane.

c.       Play Area/106 Monies
Harrogate Boro. Cncl have confirmed that Commuted Sums from The Grange can legally be utilised for the proposed Langthorpe Play Area and therefore have transferred these monies to the their records. As there is no ‘spend by date’ on the bulk of these funds, together with the ongoing councillors attempts to find a play area in Kirby Hill, they requested that the commuted sum be transferred back to Kirby Hill. Cllr Owens will advise Langthorpe P.C at the JPC meeting of this issue. Monies to be used by September 2006 can be transferred to Langthorpe. Proposed by Cllr Owens, seconded by Cllr Wilkinson.
Cllr Graham suggested that the Parish Council be more vigilant in the future with new developments linked to Commuted Sums

d.      Yore Vision (Boroughbridge Partnership/Market Town Initiative
Cllr Smailes read an updated report from Mr Rae on the above. A map relating to the geographical area which Yore Vision covers was requested

e.       Rural Housing Trust
The Trust is trying to find development sites for affordable housing; anyone having knowledge of available land/property to contact Cllr Smailes.

8.      FURTHER UPDATES ON ONGOING MATTERS

a.       B6265 Lay-by
NYCC & the P.C. had agreed a scheme to close the south end of the lay-by, thus preventing overnight parking of HGVs. With a quote of £37, 00.00 received, Cllr Owens had since arranged for a local landscape architect to assist with some of the plans. It was suggested that commuted funds might be utilised toward this project.

b.      MSA
Cllr Owens stated it was now 3 years since the Public Inquiry into the proposed MSA. Heather Ive’s appeal had not yet come to court; should Mrs Ive eventually be successful, a further P.I. will materialise. He feels reassured after the success of the last P.I, plus the above points, the Rams/P.C. will be successful.

c.       VDS
Cllr Owens confirmed that the consultancy was now completed & a draft VDS to be produced. A written report, summarising conclusions, had been formed by the Sheffield University students and would be utilised within the VDS.

d.      Speeding/Car Parking Leeming Lane
This is being dealt at JPC

e.       Lighting – St Johns Walk
Mrs Jacobs had pursued this issue with I.U.S. Cllr Graham advised that the lighting would not be completed until all Mr Ellis’ housing development on
St Johns Walk had been finished.

f.        New House – Old School Grounds, Kirby Hill
Cllr Owens had written to Hg. Boro. Cncl. advising that the new house was ‘not in keeping with the overall village scene’. He will invite planners to visit, asking for an explanation on the policy of keeping property within the surrounding scene/environment.

g.       Speeding, Milby to Brafferton/Re site 30mph sign in Kirby Hill
Pursued by Mrs Jacobs; awaiting Traffic Order Notice. NYCC wished Cllr Proctor a ‘happy retirement’ and wished Mrs Jacobs well when she moved away.

h.       Kirby Hill Crossroads-Large Stone
Cllr Smailes was still unaware of the nature/use of the ‘marker’ stone. It is now listed as an Archaeological Stone and therefore should not be removed. It appears there are a 3 such stones in the surrounding area–Kirby Hill, Milby & Cundall.
