KIRBY HILL & DISTRICT PARISH COUNCIL

(Incorporating: Kirby Hill, Milby,Thornton Bridge, Humberton and Ellenthorpe)

 

A meeting of the above Parish Council was held on 10th July 2006 in the Coronation Hall, Milby, in accordance with the Local Government Act 1972, due notice having been given.  The meeting opened at 7.15 pm.

 

Present:  Cllrs. Smailes [Chairman], Graham, Helliwell, Lister, McKenzie, Merson, Parr, Wilkinson,  HDCllr N Wilson.

 

1.            Apologies:   Cllr Gareth Owens, CCllr John Watson

 

2.         Code of Conduct:  Cllr Wilkinson declared interests in items 5b, 5j, 7a and 7b.  Cllr Lister an interest in item 5a and Cllr Parr an interest in 7i.

 

3.            Minutes  of the previous meetings on 15th May 2006 & 12th June 2006  had been copied and distributed prior to this meeting. Cllrs accepted them as a true record  and they were duly signed.

 

4.            Finance & Settlement of Accounts

a)      The accounts, as of 10 July 2006, stood at £1942.92

b)      Rent of room…to pay  (x2)      ………….      £11.00

c)      Clerk’s honorarium May&June 2006 to pay   £80.00

d)      PWLB Loan repayment 1st (paid)…………  £728.67

e)      A Foster    Grass cutting 1st half yr to pay …£230.00                       

 

5.            Correspondence

a)      Letter of resignation from Cllr Owens was read by Chairman.  All 

      councillors agreed his going would be a great loss to the council and

      commented on the very valuable work he had done.  The Chairman will

      write to thank Gareth formally on behalf of the whole council. Cllr

      Graham proposed and Cllr Wilkinson seconded that Gareth should be  

      asked to continue to head the work on the Village Design Statement and

      the Parish website.                                                                ACTION GS

      The council was reassured that Gareth’s essential and highly valued work

      with the Kirby Hill RAMS, fighting the proposed MSA, would continue.

      Cllr Parr was concerned that the Parish Council was not receiving official

      information from HBC about the status of the MSA application, pointing

      out that nothing official had been received by the council on the outcome 

      of the Heather Ive appeal.  The Clerk will write to Mr Prosser at HBC to

      request that such official information is sent to the Parish Council as

      routine.                                                                                ACTION CLERK

      Cllr Parr volunteered to be the council’s focus for MSA issues, liaising as

      necessary with Gareth and the RAMS.

      Vice Chairman

      Cllr Wilkinson nominated Cllr McKenzie to take over as Vice Chairman

      from Cllr Owens.  This was seconded by Cllr Graham. Cllr McKenzie was

      pleased to accept.

 

b)      HBC LDF Site Options and Core Strategy consultation

Cllrs looked again at the Site Option plans and development limits for the Kirby Hill settlement and for the Milby employment area behind the Coronation Hall.

These were discussed at the special meeting on 12 June at which the existing development limits had been accepted. It had also been proposed that that the area of 1.8ha (refRL55 on HBC plan), having been put forward for development outside the limit was far too large for a potential development of max. 12 affordable dwellings.  A site of about 0.4ha closer to the existing line of the development limit had been suggested as more suitable. After further discussion about the dangers of infill in this MSA-sensitive area and with input from DCllr Wilson about the desirability of evidence for affordable housing need it was decided unanimously not to accept any of this parcel of land outside the development limit as potentially suitable for development for the time being.

With regard to the 5.5ha of land in Milby, behind the Coronation Hall, currently employment use, Cllrs considered that this could be redefined as mixed residential/employment use.

With regard to development potential within the Kirby Hill settlement development limit it was suggested that Ellis’s builder’s yard might in the future have potential for mixed residential development.  The clerk would communicate these decisions to HBC on the maps provided.

DCllr Wilson asked if the council would be discussing the other documents in the HBC Consultation package, notably the Core Strategy Preferred Options paper.  This was not on the agenda and the clerk explained that these aspects would be discussed at the coming Joint Parish Council meeting (13/7) at which two Kirby Hill councillors would be present.  Cllr Parr was supported by DCllr Wilson in arguing that this was not appropriate and that the full set of documents should have been brought for discussion at the meeting.  The clerk apologised for the omission and it was a agreed that a special meeting would be held on 24/7 to discuss the documents. The meeting would include the Cllrs Smailes, Parr, Graham and McKenzie.

The clerk would alert HBC that any comments on the ‘preferred options’ document would be submitted later than the 21/7 deadline.

c)      HBC Housing Survey. No action for PC beyond posting posters on

      noticeboards. Done. Concerns expressed over the appropriateness of some

      of the survey questions.

d)      NYCC Minerals&Waste Planning. Notice received of adoption of NY 

      Waste Local Plan, which can be viewed on NYCC website.

e)      NYCC Diversion of footpaths.  NYCC has acknowledged receipt of clerk’s letter outlining council’s objections to proposed diversions of Kirby Hill/Milby footpaths.  It has now come to the council’s notice that the landowner had further proposed an alternative to the original proposals. The clerk will contact NYCC Rights of Way Dept to obtain details of this.                          ACTION CLERK

f)       HBC – Civic Service.  No councillors had been able to attend this.

g)      NY Police – Local Policing Summary.  Made available for councillors to inspect. A copy of the same is to be sent to every household in N. Yorks.

h)      Anonymous letter complaining about new windows in 3-4 Burton Cottages, Humberton. No response can be made.

i)        Letter from Mr J Bentham re parking problems Leeming Lane and outside school.  Clerk had replied to this on 14 June outlining actions taken so far through NYCC and Police and inviting Mr Bentham to the meeting.  The matter is still being progressed through the Joint Parish Council meetings but the clerk reported that CCllr Watson had said he could not support a reduction in speed limit from

      40mph to 30mph for the whole length of Leeming Lane through the settlement of 

      Kirby Hill/Langthorpe, although he acknowledged there was more need for the 

      reduction at the Kirby Hill end where the car parking is.

j)        Request through Cllr McKenzie from Mr & Mrs Wilkinson in Thornton Bridge for village signs.  The cost of these would have to be borne by the parish council and there were possible siting problems for the 2 (or 3?) signs.  NYCC had indicated a rough cost of £150 per sign for the very basic design.  Possibilitty of funding through the commuted sums balance held in LA (Leisure Area) category. Clerk to write to Mr and Mrs Wilkinson to update them on position and to check with HBC about use of ‘106 monies’.                                      ACTION CLERK

k)      ‘The Local Channel’ – invitation for free link page to parish website from this national website covering over 1400 councils.  Cllrs agreed a good idea and Clerk to pass to Gareth Owens for attention.                                    ACTION CLERK

 

6.            Councillors’ /Clerk’s Reports

a)      Police liaison. Cllr Wilkinson had not managed to get to the 6 June

Meeting but drew the meeting’s attention to main items on the minutes

b)      Joint Parish Council.  Nothing to report. Next meets 13 July.

c)      Yore Vision. Clerk reported that two projects are under way:

      1. Boroughbridge ‘urban improvement’ (with Urban Design consultant) 

      and largely concentrating on visual improvements to certain areas of the

      town and   2. circular walks in the area, taking in riverside.

d)      Coronation Hall Committee. The clerk reported that the balance being

      accrued (currently standing around £35k) was destined, beyond routine

      annual expenses/contingencies, for an extension at the rear of the hall to

      provide changing rooms, meeting rooms and extra storage.

 

7.            Ongoing and other matters

 

a)      B6265 Lay-by. No report in absence of Cllr Owens.  Cllr Parr volunteered

      to contact Gareth for a handover of the documentation and update of

d)      Play Area – 106 Monies.  Clerk reported that having handed over all date-limited funds (from Grange Farm development) to Langthorpe Play Area Kirby Hill was now left with £13,300, mostly with no date limit but around   £1300 having to be used by May 2008. 

      Clerk is seeking written confirmation from HBC of the new balances in

f)       Dog Waste bins – no progress. Chased by clerk 6 July – Kirby Hill still on waiting list for next HBC assignment.  Yvonne Jacobs’ original order placed 20 March 2006.

g)      New House – old school grounds. Now sold. No further action.

h)      War Memorial – wreaths.  Clerk still awaiting reply from British Legion.

i)        Grass cutting.  Cllr Parr expressed concerns about the state of grass cutting on the green recently, acknowledging that the contractor (Aidan Foster) had been ill but concerned about adequate cover. The clerk had been assured that cover would be provided during periods of Aidan’s absence and that the service would revert to normal following a small delay to a recent cut. Cllr Parr also mentioned the general ‘scruffy’ appearance of the green when different residents fronting it were cutting small areas themselves, at different times. It was agreed to monitor the

     grass cutting situation and leave on agenda for next meeting. On a matter of raised 

     utility ‘manhole covers’ at the edge of the green, which could damage a 

                  lawnmower, Cllr Parr would find out which services they related to so that  clerk

                  could contact relevant bodies requesting levelling of the obstacles.
